Terms and Conditions
1. Definitions
“We”, “us”, “our” refer to Bespoke Rustic Oak.
“You”, “your” refer to the customer.
“Goods” means made-to-order and standard products supplied by us.
2. Contract Formation
All orders constitute an offer by you to purchase Goods. A legally binding contract is formed only when we issue written order confirmation.
For bespoke or made-to-measure Goods, the order confirmation, including drawings/specifications (where applicable), forms the agreed contract specification.
3. Bespoke and Made-to-Order Goods
All bespoke items are manufactured to your specifications. It is your responsibility to ensure all measurements, access requirements, and specifications are accurate.
Once production has commenced, orders for bespoke Goods cannot be cancelled or amended.
Minor variations in dimensions (typically within ±5 mm) may occur due to manufacturing tolerances and shall not constitute a defect.
4. Natural Materials Disclaimer (Critical Clause)
All Goods are made from solid rustic oak, a natural material subject to:

grain variation
-
knots, splits, and character markings
-
colour variation and ageing
-
movement due to humidity and temperature changes
These characteristics are inherent and shall not be considered faults.
We strongly recommend maintaining stable indoor humidity and avoiding placement near direct heat sources (e.g., radiators, underfloor heating outlets). Failure to do so may void any goodwill remedies.
5. Pricing and Payment
All prices are in GBP and include VAT unless stated otherwise.
For bespoke orders, we reserve the right to require full payment upfront or a non-refundable deposit (if agreed separately).
Title to Goods remains with us until full payment is received in cleared funds.
6. Lead Times and Delivery
Estimated lead times (e.g., “within 8 weeks”) are indicative only and not guaranteed. Delays do not constitute grounds for cancellation or compensation.
Delivery is kerbside unless otherwise agreed in writing. You are responsible for:

ensuring adequate access

arranging sufficient manpower for heavy items
If delivery fails due to access issues or absence, we reserve the right to charge re-delivery and storage fees.
Risk transfers to you upon delivery.
7. Inspection and Claims
You must inspect Goods upon delivery.

Visible damage must be recorded on the delivery note and reported within 24 hours

Hidden defects must be reported within 48 hours
Failure to comply may limit our ability to investigate claims, without affecting your statutory rights under the Consumer Rights Act 2015
8. Consumer Cancellation Rights
Under the Consumer Contracts Regulations 2013, cancellation rights do not apply to bespoke or personalised Goods.
For non-bespoke items, you may cancel within 14 days of delivery.
Returned items must be:

unused
-
in original condition
-
suitably packaged
You are responsible for return costs unless the item is faulty.
9. Returns (Non-Faulty Goods)
For standard (non-bespoke) Goods, unwanted returns may be accepted at our discretion.
A minimum collection/restocking fee of £75 will apply, which may be higher depending on item size and logistics.
10. Faulty Goods and Remedies
If Goods are faulty, not as described, or not of satisfactory quality, your rights are governed by the Consumer Rights Act 2015.
We reserve the right to:

repair

replace
-
or refund
Remedies will be proportionate and subject to inspection of the Goods.
11. Limitation of Liability
Nothing in these Terms limits liability for:

death or personal injury caused by negligence

fraud or fraudulent misrepresentation
Subject to this, we shall not be liable for:

indirect or consequential losses
-
loss of profit, business, or opportunity
Our total liability shall not exceed the purchase price of the Goods.
12. Care and Maintenance
You are responsible for proper care of the Goods after delivery.
Failure to follow care guidance (including exposure to heat, moisture imbalance, or misuse) may result in:

cracking
-
warping
-
joint movement
Such issues are not considered manufacturing defects.
13. Force Majeure
We are not liable for delays or failures caused by events beyond our control, including supply chain disruption, material shortages, or transport issues.
14. Website and Intellectual Property
All content on this Website is owned by or licensed to us. You may not reproduce or use it for commercial purposes without consent.
15. Data Protection
We process personal data in accordance with the UK GDPR and do not sell customer data to third parties.
16. Governing Law
These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the English courts.
17. Acceptance
By placing an order, you confirm that you:
